Terms and Conditions of Service

Introduction
These Terms and Conditions ("Terms") govern your use of products and services provided by TIME DROPS LLC ("TIME DROPS," "we," "us," or "our"), including:
- TIME DROPS Swim Timing System - Timing system hardware and software
- TIME DROPS Live - Mobile applications for iOS and Android
- Website - www.time-drops.com, live.time-drops.com, scoreboard.time-drops.com
- Related software, firmware, and cloud services (collectively, the "Services")
BY PURCHASING, DOWNLOADING, INSTALLING, OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
If you do not agree to these Terms, do not use our Services.
1. Definitions
- "Services" - All TIME DROPS products, software, applications, and services
- "Swim Timing System" - Complete timing solution including:
- Hardware devices (with embedded firmware): STC-1 Swim Timing Controller, wireless buttons, wireless adapters
- Software applications: Console, TIME DROPS Live, TIME DROPS Scoreboard, MM-Link
- Associated cloud services and support
- "TIME DROPS Console" - TIME DROPS timing software application (runs on user-provided laptop or tablet)
- "TIME DROPS Live" - Mobile application for spectators (runs on user-provided smartphone), also https://live.time-drops.com
- "TIME DROPS Scoreboard" - Scoreboard display application (runs on user-provided smart TV or tablet), also https://scoreboard.time-drops.com
- "TIME DROPS MM-Link" - Meet Manager integration software (runs on user-provided laptop or tablet)
- "User," "you," "your" - Person or organization using Services
- "Meet Operator" - Person or organization operating timing system at swimming meet
- "Spectator" - Person using TIME DROPS Live to view meet results
- "Content" - Data, information, results, or other material created or transmitted using Services
2. Acceptance of Terms
2.1 Agreement
By using our Services, you represent that:
- You are at least 18 years of age
- You have the authority to enter into these Terms
- You will comply with all applicable laws and regulations
- All information you provide is accurate and complete
2.2 Updates to Terms
We may modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date.
Material changes will be communicated via:
- Email notification (if we have your email address)
- Prominent notice on website or in applications
- In-app notification
Continued use of Services after changes constitutes acceptance of modified Terms.
If you do not agree to modified Terms, you must stop using the Services.
3. Services Description
3.1 TIME DROPS Swim Timing System
Complete Timing Solution:
Hardware Devices (with embedded firmware manufactured by TIME DROPS LLC):
- STC-1 Swim Timing Controller - Main timing and control unit
- Wireless buttons - Semi-automatic timing (backup/manual timing)
- Wireless adapters - Connect touchpads and start devices wirelessly
Software Applications (run on user-provided devices):
- TIME DROPS Console - Timing and meet management software (laptop/tablet)
- TIME DROPS Live - Spectator results viewing app (smartphone)
- TIME DROPS Scoreboard - Scoreboard display application (smart TV/tablet)
- TIME DROPS MM-Link - Meet Manager integration (laptop/tablet)
Important: Standard messaging and data rates may apply when using mobile applications (TIME DROPS Live) or cloud-connected features. You are responsible for any charges from your mobile carrier or internet service provider.
User-Provided Hardware (NOT included, NOT covered under warranty):
- Laptops, tablets, smartphones, smart TVs that run our software applications
- Standard consumer electronics (even if purchased through us)
- Wireless routers and networking equipment
- Touchpads (unless manufactured by TIME DROPS LLC)
- Scoreboards
Purpose: Accurate timing and management of competitive swimming events.
3.2 Cloud Services
Backend Services:
- Meet data synchronization
- Result publication and distribution
- Push notification delivery
- Performance data collection and analytics
- Software updates and distribution
4. Account Registration and Access
4.1 Account Creation
To use certain Services (e.g., purchasing products, publishing meets), you must create an account:
- Provide accurate, complete information
- Maintain security of your account credentials
- Notify us immediately of unauthorized access
- You are responsible for all activity under your account
4.2 Account Security
Your Responsibilities:
- Keep password confidential
- Use strong, unique password
- Do not share account credentials
- Log out from shared devices
We are not liable for losses resulting from unauthorized account access due to your failure to maintain security.
4.3 Account Suspension or Termination
We may suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- You engage in fraudulent activity
- We are required by law
- We discontinue Services (with reasonable notice)
You may terminate your account at any time by contacting us at support@time-drops.com.
5. Purchases and Subscriptions
5.1 Product Purchases
Hardware Products:
- Pricing displayed on website
- Payment processed via Stripe or PayPro Global
- Shipping terms and costs specified at checkout
- All sales are subject to our return policy (Section 5.3)
Taxes:
- Prices exclude applicable sales tax, VAT, or similar charges
- You are responsible for all taxes associated with your purchase
5.2 Subscriptions
Annual Subscription Model:
- Billing: Annual subscriptions only (billed once per year)
- Renewal: Manual renewal (not automatic by default)
- Payment Process:
- We will send invoice 30 days before subscription expires
- Payment due within 30 days of invoice date
- Subscription automatically cancels if payment not received within 30 days
- Automatic Payment: Optional opt-in for automatic annual renewal
- Price changes: Require 30 days notice before renewal
- Cancellation: Cancel anytime (effective end of current annual period)
First Year/Season Free with Hardware Purchase:
- Included with purchase: When you purchase TIME DROPS hardware, your first subscription period is included at no additional charge
- Year-round customers: First subscription period is 12 months from date of purchase
- Seasonal customers: First subscription period is adjusted to cover your first competition season
- Example: Summer league team purchasing in October 2025 receives subscription through end of first season (approximately April 2027)
- First renewal invoice sent in time for second season
- Billing cycle adjustments: Upon request, we can adjust your billing cycle to align with your competition season (within reason)
- Contact us at support@time-drops.com to discuss billing cycle that works best for your needs
Subscription Includes:
- Use of TIME DROPS Swim Timing System (hardware and software)
- Email and phone technical support
- Software updates and bug fixes
- Hardware repair or replacement for TIME DROPS LLC manufactured hardware devices (STC-1, wireless buttons, wireless adapters) - see Section 9.1 for details and exclusions
- Software applications (Console, TIME DROPS Live, TIME DROPS Scoreboard, MM-Link) are included with subscription
Payment Processors:
- U.S. Subscriptions: Processed via Stripe
- International Subscriptions: Processed via PayPro Global
5.3 Refunds and Returns
Hardware Products - 30-Day Satisfaction Guarantee:
- Return period: 30 days from date of delivery
- Reason: If not satisfied for any reason - you may return for full refund
- What we ask: We will ask questions to understand your experience and improve our products, but we will not challenge your return
- Refund amount: Full purchase price less shipping and handling charges
- No restocking fees: We do not charge restocking fees - you receive the full product price back
- Return shipping: Customer responsible for return shipping costs
- Condition: Product must be in resalable condition with original packaging
- How to return:
- Contact support@time-drops.com within 30 days of delivery
- We will provide return authorization and instructions
- Ship product back to us (you pay return shipping)
- Refund processed within 14 days of receipt
- Refund method: Original payment method
Items NOT Eligible for Return:
- Products damaged due to misuse, abuse, or negligence
- Products modified or altered
- Products missing components or accessories
- Returns initiated after 30-day period
Software Subscriptions:
- First year/season included with hardware purchase (no separate charge to refund)
- Subsequent subscription renewals: No refunds for partial billing periods
- Cancel anytime to avoid future charges
- Prorated refunds at our sole discretion (e.g., for extended service outages)
Defective Products:
- Covered under warranty (see Section 9.1)
- Active subscribers: Repair/replacement at no charge
- Non-subscribers: May be eligible for refund or replacement within warranty period
5.4 Payment Terms
Payment is due immediately upon purchase or subscription renewal.
Failed or Late Payments:
- Subscription automatically cancels if payment not received within 30 days of invoice
- No grace period for services (access ends when subscription expires)
- To reactivate, must pay current year's subscription fee
When Subscription Expires or Lapses:
Feature Limitations:
When your subscription expires (or payment is not received), we may limit or disable system features, including but not limited to:
- Export functionality (e.g., Meet Manager export) - Currently blocked when subscription lapses
- Cloud synchronization and backup features
- Advanced reporting and analytics
- Remote access and mobile app features
- Technical support (email and phone)
- Software updates and bug fixes
Basic Timing Functionality:
- You may still be able to record times locally
- Results may be viewable on the console
- However: You will need to manually copy and paste results (no automated export)
- Data may not sync to cloud or TIME DROPS Live
System Disablement:
We reserve the right to disable the system entirely if:
- Subscription has lapsed for extended period
- Previous payment disputes or chargebacks
- Violation of these Terms
- We determine continued use without subscription is inappropriate
We will make reasonable efforts to:
- Provide notice before complete system disablement
- Allow time to renew subscription or retrieve data
- Work with customers experiencing payment difficulties
To Avoid Interruption:
- Renew subscription before expiration date
- Respond promptly to renewal invoices
- Contact us immediately if you have payment issues
- Consider opting in to automatic renewal
6. Use of Services
6.1 Permitted Use
You may use Services for:
- Timing competitive swimming events
- Managing swim meets
- Viewing meet results (TIME DROPS Live)
- Legitimate personal or business purposes
6.2 Prohibited Use
You may NOT:
- Use Services for any illegal purpose
- Violate any laws or regulations
- Infringe intellectual property rights
- Transmit harmful code (viruses, malware, etc.)
- Attempt to hack, reverse engineer, or compromise Services
- Interfere with other users' access
- Impersonate any person or entity
- Collect user data without consent
- Use automated systems (bots, scrapers) without permission
- Resell or redistribute Services without authorization
- Publish false, misleading, or defamatory content
- Violate privacy of swimmers or participants
- Use Services in any way that could damage our reputation
Violation may result in account termination and legal action.
6.3 Meet Operator Responsibilities
If you publish meet results using TIME DROPS Live, you are responsible for:
- Obtaining necessary consents from swimmers/parents for publishing names and results
- Complying with privacy laws (COPPA, GDPR, etc.)
- Protecting PIN codes - Only share with authorized spectators
- Accuracy of information - Verify results before publishing
- Removing content upon request if required by law or privacy concerns
- Complying with governing body rules (USA Swimming, FINA, etc.)
We are not responsible for content you publish or privacy violations arising from your publication of meet data.
6.4 Spectator Responsibilities (TIME DROPS Live)
If you use TIME DROPS Live, you agree to:
- Only access meets for which you have been provided PIN code
- Not share PIN codes publicly
- Not misuse personal information (swimmer names, ages)
- Respect privacy of swimmers
- Not use information for commercial purposes without consent
7. Intellectual Property
7.1 Our Intellectual Property
Ownership:
- Services, including software, firmware, designs, and trademarks, are owned by TIME DROPS LLC
- Protected by copyright, trademark, and other intellectual property laws
- All rights reserved
Trademarks:
- "TIME DROPS" and related logos are trademarks of TIME DROPS LLC
- You may not use our trademarks without written permission
7.2 License to Use Software
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Use Console software on hardware you purchase
- Use TIME DROPS Live app on your personal devices
- Access cloud services associated with your account
Restrictions:
- You may not copy, modify, or distribute software
- You may not reverse engineer or decompile software
- You may not remove copyright notices or proprietary markings
- License terminates upon violation of Terms
7.3 Your Content
Content You Create:
- Meet data, results, and information you input or publish
- You retain ownership of your content
License to Us:
By publishing content via Services, you grant us a limited license to:
- Store, process, and transmit your content
- Display content to authorized users (PIN holders)
- Back up and secure your content
- Provide Services as described
This license:
- Ends when you delete content (subject to backup retention)
- Does not transfer ownership
- Is only for providing Services
You represent that:
- You own or have rights to content you publish
- Content does not violate third-party rights
- Content complies with applicable laws
8. Timing Accuracy and Disclaimers
8.1 Timing System Accuracy and Equipment Testing
IMPORTANT - READ CAREFULLY:
The TIME DROPS Swim Timing System is designed to provide accurate timing for competitive swimming events. When functioning properly, the system provides reliable, accurate timing data.
However, like any electronic system, the equipment may fail to operate or capture times due to:
- Environmental conditions (RF interference, extreme temperature or humidity, etc.)
- Improper installation, setup, or configuration
- User error or operator inexperience
- Hardware or software defects
- Battery depletion:
- Non-rechargeable batteries in wireless buttons and adapters
- Uncharged or degraded rechargeable battery in STC-1 Controller
- Improper storage (e.g., freezing temperatures damaging rechargeable batteries)
- Third-party equipment failures or incompatibilities (touchpads, scoreboards, network equipment)
- Network connectivity or configuration issues
- Physical damage or wear to equipment
Important distinction:
- When the system works, times are accurate
- The risk is system failure (no time recorded), not inaccurate times
- This is why backup timing is essential - to cover the possibility of system failure
Our Commitment:
We WILL make every reasonable effort to:
- Provide technical support to resolve issues
- Troubleshoot problems remotely when possible
- Repair or replace defective equipment (for active subscribers)
- Respond promptly to support requests
- Deliver software updates and bug fixes
We CANNOT guarantee:
- Immediate resolution of all issues
- Same-day replacement of failed equipment
- Compatibility with all third-party equipment
- Success in resolving issues caused by user error or environmental factors
Your Responsibilities:
As meet operator, you are responsible for:
1. Backup Timing Systems (CRITICAL):
- ALWAYS use backup timing as required by governing bodies
- Manual stopwatches, secondary timing console, or other approved methods
- Governing bodies (USA Swimming, FINA, etc.) typically require multiple timing methods
2. Pre-Meet Testing (STRONGLY RECOMMENDED):
- Test equipment well in advance of critical meets (at least 1 week preferred)
- Test all features you plan to use (wireless adapters, scoreboard integration, etc.)
- Verify touchpad connections and wireless signal strength
- Confirm battery levels in all wireless adapters
- Run practice heats to verify timing accuracy
- Test backup systems
3. Timely Issue Reporting:
- Report issues immediately when discovered
- Contact support as soon as problems occur (don't wait until day before meet)
- Provide adequate time for troubleshooting, repair, or replacement
- We cannot guarantee same-day fixes for issues reported the day before a meet
4. Proper Installation and Configuration:
- Follow installation instructions and best practices
- Ensure proper placement of wireless adapters and equipment
- Verify network configuration and connectivity
- Have qualified operators familiar with the system
5. Battery Maintenance:
- Wireless buttons and adapters: Monitor battery levels, replace non-rechargeable batteries proactively
- STC-1 Controller: Keep charged, don't leave discharged for extended periods
- Storage: Keep rechargeable devices out of freezing temperatures
- Keep spare non-rechargeable batteries on hand for meets
- Test battery levels before important meets
6. Following Governing Body Rules:
- Comply with all timing system requirements of your governing body
- Verify that TIME DROPS system meets requirements for your meet level
- Obtain any necessary certifications or approvals
7. Verifying Results:
- Always verify times before publishing official results
- Compare with backup timing if any discrepancies
- Use judgment and follow governing body protocols for disputed times
We are NOT liable for:
Direct Damages:
- Incorrect times or results
- Equipment malfunction or failure
- Software bugs or errors
- Data loss or corruption
- Inability to complete meet
Indirect/Consequential Damages:
- Disqualified meets due to timing issues
- Disputes over race outcomes
- Lost opportunities (scholarships, records, qualifying times, etc.)
- Emotional distress or reputational harm
- Lost revenue from canceled or rescheduled meets
- Travel expenses for rescheduled meets
- Any other consequential or incidental damages
Even if:
- Issue was due to our equipment defect
- We were unable to resolve issue in time for your meet
- You reported issue well in advance and we failed to fix it
- You followed all instructions and best practices
Maximum Liability:
Our total liability is limited to repair/replacement of defective equipment (for subscribers) or refund of purchase price (whichever is less). See Section 9.3 for complete limitation of liability.
Critical Meets:
If you have an important championship or qualifying meet:
- Test equipment at least 1 week in advance
- Contact support immediately if any issues arise
- Have backup equipment available if possible
- Ensure backup timing systems are in place and tested
- Brief all operators on procedures
- Have our support contact information readily available
We strongly recommend having a backup console or manual timing system for critical meets.
USE BACKUP TIMING SYSTEMS AS REQUIRED BY YOUR GOVERNING BODY.
8.2 System Availability
Services are provided "AS AVAILABLE."
We do not guarantee:
- Uninterrupted service
- Error-free operation
- Services will meet your requirements
- Data will always be accurate or complete
Service Interruptions may occur due to:
- Maintenance (scheduled or emergency)
- Technical issues
- Third-party service failures (Google, payment processors)
- Internet connectivity issues
- Force majeure events
We will make reasonable efforts to:
- Minimize planned downtime
- Notify users of scheduled maintenance
- Restore services promptly after outages
We are not liable for damages resulting from service interruptions.
9. Warranty and Liability
9.1 Hardware Warranty and Repair Coverage
For Active Subscribers:
Subscription Includes Hardware Repair/Replacement:
- Coverage: Active annual subscription includes repair or replacement of TIME DROPS LLC manufactured hardware devices (with embedded firmware) for any reason
- Covered Equipment:
- STC-1 Swim Timing Controller
- Wireless buttons (semi-automatic timing)
- Wireless adapters (for touchpads and start devices)
- Other TIME DROPS LLC manufactured hardware devices with embedded firmware
- Coverage Includes: Water damage, physical damage, accidents, drops, normal wear and tear, defects in materials or workmanship
- Remedy: Repair or replacement at our sole discretion
- Defective Unit Must Be Returned: You must return the damaged/defective equipment to receive replacement
Equipment NOT Covered (Even If Purchased Through Us):
- ❌ User-provided hardware that runs our software applications:
- Laptops, tablets, computers (run Console, MM-Link)
- Smartphones (run TIME DROPS Live)
- Smart TVs, display tablets (run TIME DROPS Scoreboard)
- ❌ Standard consumer electronics
- ❌ Wireless routers and networking equipment
- ❌ Touchpads (unless manufactured by TIME DROPS LLC)
- ❌ Scoreboards
- ❌ Any third-party manufactured equipment
Software vs. Hardware:
- ✅ Software applications (Console, TIME DROPS Live, TIME DROPS Scoreboard, MM-Link) are covered - you get updates and support
- ❌ Devices that run the software (laptops, tablets, smartphones, smart TVs) are NOT covered - these are user-provided hardware
Battery Replacement and Care:
Non-Rechargeable Batteries (User Responsibility):
- ❌ User-replaceable, non-rechargeable batteries are NOT covered
- Used in:
- Wireless buttons (semi-automatic timing)
- Wireless adapters (for touchpads and start devices)
- Batteries are consumable items (not covered by subscription or warranty)
- Service Fee: If equipment returned as "defective" but only needs battery replacement, we will charge a $50 service fee plus battery cost
- Recommendation:
- Keep spare batteries on hand for meets
- Test battery condition before returning equipment
- Replace batteries proactively based on usage
Rechargeable Batteries (Covered):
- ✅ Rechargeable lithium batteries ARE covered (if defective)
- Used in:
- STC-1 Swim Timing Controller
- Other rechargeable TIME DROPS devices
- Battery must be defective (won't charge, won't hold charge, etc.)
- Normal battery degradation over time is expected and not considered defective
Battery Care Requirements:
- STC-1 Controller and rechargeable devices:
- Keep out of freezing temperatures (protects battery life)
- Store in cool, dry place when not in use
- Charge regularly (don't leave completely discharged for extended periods)
- Avoid extreme heat (don't leave in hot vehicles)
- Non-rechargeable batteries:
- Store in cool, dry place
- Check expiration dates
- Remove from equipment if storing long-term
Coverage DOES NOT Include:
- ❌ Lost or stolen equipment (defective unit must be returned for replacement)
- ❌ Cosmetic damage that doesn't affect functionality (scratches, dents, discoloration)
- ❌ Willful destruction or intentional damage
- ❌ Unauthorized modifications (opening sealed units, circuit modifications, firmware hacks)
- ❌ Non-rechargeable batteries (user-replaceable consumables)
- ❌ Software issues (covered separately under subscription support)
- ❌ Third-party equipment (even if purchased through us)
Note on "For Any Reason" Coverage:
While we cover most damage including accidents and water damage, we reserve the right to deny claims for:
- Evidence of intentional destruction
- Repeated abuse or negligence
- Fraudulent claims
- Failure to return defective equipment
For Non-Subscribers:
Limited 1-Year Warranty:
- Duration: 1 year from date of purchase (for customers without active subscription)
- Coverage: Defects in materials and workmanship under normal use only
- Remedy: Repair or replacement at our option
- Cost: Customer pays shipping both ways; repair labor may be charged
To Make Warranty or Repair Claim:
- Contact us at support@time-drops.com
Provide:
- Proof of purchase or subscription status
- Description of issue
- Serial number of equipment
- Troubleshooting steps already attempted
- Photos of damage (if applicable)
Troubleshooting: We will attempt to diagnose issue remotely first
Return Authorization: If return necessary, we will provide RMA (Return Merchandise Authorization) number
- You must have RMA number before shipping
- Returns without RMA may be refused or delayed
Shipping Costs:
Initial 12-Month Warranty Period:
- We pay standard ground shipping both ways (if defect confirmed)
- Expedited/overnight shipping: Customer pays difference
- International shipping: Customer pays unless otherwise agreed
After 12 Months (Active Subscribers):
- Customer pays shipping costs to us
- We pay standard ground shipping back to customer
- Expedited/overnight shipping: Customer pays difference
- International shipping: Customer pays unless otherwise agreed
Non-Subscribers:
- Customer pays shipping both ways
- Customer may be charged for repair labor
Return the Defective Unit:
- You must return the damaged/defective equipment
- Ship to address provided with RMA
- Pack securely to prevent further damage in transit
- Include RMA number on outside of package
Repair/Replacement:
- We will repair or replace at our discretion
- Replacement may be new or refurbished unit
- Return equipment typically ships within 5-10 business days after receipt
Expedited Advance Replacement (Urgent Cases):
- In urgent situations (e.g., meet scheduled within days), we may, at our sole discretion, advance a replacement unit immediately before receiving the defective unit
- Your obligation: You must return the defective unit within 14 days of receiving replacement
- Failure to return: If you fail to return the defective unit within 14 days, we may charge you the full retail price of the replacement unit
- Shipping: You are responsible for shipping the defective unit back to us (unless initial 12-month warranty period)
- This is offered as a courtesy and is not guaranteed for all situations
Turnaround Time:
- Standard: 5-10 business days after we receive equipment
- Expedited service available (additional fee)
- International returns may take longer
- Advance replacement (if approved): Ships immediately
Shipping Tips:
- Use tracking and insurance for valuable equipment
- Keep proof of shipment
- We are not responsible for items lost or damaged in transit to us
THIS IS YOUR SOLE WARRANTY FOR HARDWARE. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.
9.2 Software Warranty
SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
We disclaim all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness
- Error-free operation
We do not warrant that:
- Software will meet your requirements
- Software will operate uninterrupted or error-free
- Defects will be corrected
- Software is compatible with all systems
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, revenue, data, or opportunities
- Cost of substitute products or services
- Personal injury or property damage (except as required by law)
- Errors in timing or results
- Meet disqualifications or disputes
- Lost records, scholarships, or competitive opportunities
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MAXIMUM LIABILITY:
Our total liability for all claims related to Services shall not exceed the amount you paid us in the 12 months prior to the claim, or $500, whichever is greater.
Exceptions:
Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9.4 Indemnification
You agree to indemnify, defend, and hold harmless TIME DROPS LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use of Services
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you publish or transmit
- Meet results you publish

- Disputes over timing or results at meets you operate
- Any negligence or willful misconduct

10. Data and Privacy
10.1 Privacy Policy
Your use of Services is also governed by our Privacy Policy:

10.2 Data Ownership
Your Data:
- Meet results, swimmer information, and content you create belong to you
- We only have a license to process and store data as needed to provide Services
Performance Data:
- Technical data collected from Console belongs to us
- Used for product improvement only
- Not linked to personal information
Backups:
- We maintain backups for disaster recovery
- Backups may be retained for 90 days after data deletion
- Backups are for recovery only, not for providing data access after account termination
10.3 Data Deletion
You may request deletion of:
- Account information
- Published meet results
- Personal data we hold about you
Contact us at support@time-drops.com to request deletion.
We will delete data within 30 days, except:
- Data required for legal or accounting purposes (retained for 7 years)
- Anonymized performance data (may be retained for product development)
- Backup data (deleted within 90 days)
11. Third-Party Services
11.1 Payment Processors
Payments are processed by:
- Stripe (U.S. purchases and subscriptions)
- PayPro Global (International subscriptions)
Use of payment services is subject to their terms:

Use of third-party services is at your own risk.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of California, United States, without regard to conflict of law principles.
12.2 Venue
Any disputes shall be resolved in the state or federal courts located in Contra Costa County, California.
You consent to personal jurisdiction in these courts.
12.3 Dispute Resolution Process
Before Filing Suit:
You agree to attempt informal resolution:
- Send written notice of dispute to support@time-drops.com
- Include description of dispute and desired resolution
- We will respond within 30 days
- We will attempt good-faith negotiation for 60 days
If Informal Resolution Fails:
You may pursue claims in small claims court or through binding arbitration (your choice).
12.4 Arbitration (Optional)
Either party may elect binding arbitration:
- Administered by American Arbitration Association (AAA)
- AAA Consumer Arbitration Rules apply
- Single arbitrator
- Location: Walnut Creek, California or mutually agreed location
- Costs shared equally (unless rules require otherwise)
- Each party bears own attorney fees (unless arbitrator awards fees)
Arbitration Agreement:
- Disputes resolved on individual basis (no class actions)
- Arbitrator's decision is final and binding
- Judgment may be entered in any court
You may opt out of arbitration by sending written notice within 30 days of first accepting these Terms to support@time-drops.com.
12.5 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS.
You waive any right to:
- Bring class action claims
- Participate in class arbitrations
- Join claims with other users
If class action waiver is found unenforceable, arbitration agreement does not apply to that claim.
12.6 Time Limit for Claims
You must bring any claim within 1 year of the event giving rise to the claim.
Claims not brought within 1 year are waived.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TIME DROPS LLC regarding Services.
Supersedes all prior agreements or communications.
13.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
Invalid provision will be modified to the minimum extent necessary to make it enforceable.
13.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Waiver of any breach does not waive future breaches.
13.4 Assignment
You may not assign these Terms without our written consent.
We may assign these Terms to any successor entity (e.g., in merger or acquisition).
13.5 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control:
- Natural disasters
- War, terrorism, civil unrest
- Government actions
- Internet or telecommunications failures
- Pandemics or health emergencies
13.6 Notice
To You:
- We will send notices to email address associated with your account
- Or by posting on website/app
- Notices effective immediately upon sending
To Us:
- Send notices to support@time-drops.com
- Include your name, account information, and reason for contact
- We will respond within 5 business days
13.7 Export Compliance
Services may be subject to U.S. export control laws.
You may not:
- Export or re-export Services to prohibited countries
- Use Services in violation of U.S. export laws
- Transfer Services to prohibited persons or entities
You represent that you are not located in a prohibited jurisdiction and are not on any U.S. government restricted party list.
13.8 U.S. Government Rights
If Services are used by U.S. Government, software is "commercial computer software" subject to limited rights per FAR 12.212 and DFARS 227.7202.
13.9 Survival
Provisions that by their nature should survive termination will survive, including:
- Intellectual property rights
- Warranty disclaimers
- Limitation of liability
- Indemnification
- Dispute resolution
- General provisions

BY USING SERVICES, YOU ACKNOWLEDGE THAT:

IF YOU DO NOT AGREE, DO NOT USE SERVICES.
These Terms and Conditions are effective as of November 18, 2025 and supersede all prior versions.
